Rowe and Co Property Advisory Pty Ltd trading as Rowe & Co Property (Rowe & Co, we, us or our) respects your privacy and is committed to handling personal information responsibly.
This Privacy Policy explains how we collect, hold, use and disclose personal information, including information collected through www.roweandcoproperty.com.au (the Website).
We manage personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles to the extent they apply to us. We also use the Australian Privacy Principles as a general benchmark for responsible information handling.

2. Personal information we collect
The personal information we collect depends on how you interact with us and may include:
your name, email address, telephone number and residential or postal address;
information included in an enquiry, booking or consultation request;
your property requirements, preferred locations, budget, timing, objectives and circumstances;
information about a property you own, are considering purchasing or are considering selling;
records of telephone calls, emails, meetings and other communications;
information required to prepare proposals, agreements or provide property services;
reviews, comments, photographs, testimonials and other community content you submit;
your marketing and communication preferences;
information relating to complaints, disputes or feedback;
Website and device information, including your IP address, browser, device type, approximate location, referring website and pages visited; and
any other information you voluntarily provide.
If we are required to conduct customer identification or due-diligence procedures, we may also collect:

operate, secure, maintain and improve the Website;

administer complaints and resolve disputes;
protect against fraud, misuse and security threats;
comply with legal, licensing, regulatory and professional obligations;
conduct customer identification and due diligence where required;
establish, exercise or defend legal claims; and
send marketing communications where we have appropriate consent or another lawful basis.
If you do not provide information we reasonably require, we may be unable to respond to your enquiry, arrange a consultation, verify a submission, enter into an agreement or provide services.
5. Anti-money laundering obligations
From 1 July 2026, certain services provided by real-estate professionals, including buyer’s agents, may be subject to obligations under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) and related rules.
Where those obligations apply, we may be required or authorised by law to:
collect and verify identity and beneficial-ownership information;
conduct customer and transaction due diligence;
assess and monitor money-laundering and terrorism-financing risks;
keep records for legally prescribed periods; and
provide information to AUSTRAC or another authorised government body.
Where permitted or required by law, we may be unable to tell you about certain disclosures.
6. Reviews and community content
If we invite you to provide, or make facilities available for submitting, a review, testimonial, comment, photograph or other community contribution, the information you submit for publication may become publicly available.
Published content may:
display your name, initials or chosen display name;
be indexed by search engines;
be shared through the Website or Rowe & Co’s owned social-media channels; and
be copied or shared by other people outside our control.
Please do not include confidential information, property addresses, financial details or another person’s personal information in public content unless you are authorised to do so.
We may retain contact and verification information privately to confirm that a review or testimonial reflects a genuine experience.
We will seek separate permission before using identifiable content in paid advertising or a materially different promotional campaign.
7. Direct marketing
Submitting an enquiry, arranging a consultation or becoming a client does not automatically subscribe you to newsletters or general marketing communications.
We will only send commercial electronic messages where you have given express consent or where consent may lawfully be inferred under the Spam Act 2003 (Cth). We ordinarily obtain separate, express consent before sending newsletters, property insights or general promotional emails.
We keep appropriate records of marketing consent, including when and how consent was provided.
Our marketing communications will identify Rowe & Co, include current contact details and provide a clear and simple way to unsubscribe.
You may opt out at any time by:
using the unsubscribe facility in the communication;
replying with “unsubscribe”; or
contacting nate@roweandco.au.
Unsubscribe requests are free and will be actioned within five working days. Our electronic unsubscribe facilities will remain functional for at least 30 days after the relevant communication is sent.
Opting out of marketing will not prevent us from sending communications reasonably necessary to respond to an enquiry, arrange a consultation or provide services under an existing engagement.
Where applicable, you may ask us to identify the source of personal information used for direct marketing. We will provide that information unless doing so would be unreasonable or impracticable.
We do not sell personal information or provide it to unrelated organisations for their own direct-marketing purposes.8. Website analytics and cookies
The Website is hosted by Squarespace.
Squarespace and its service providers may collect technical information about visits to the Website, including:
IP address and approximate location;
browser and operating-system information;
device information;
pages visited and time of access;
referral sources; and
Website interactions.
You can restrict or manage cookies through your browser settings. If we make Website cookie-management controls available, you may also use those controls to manage non-essential cookies. Restricting cookies may affect some Website functionality or the accuracy of analytics.
9. Disclosure of personal information
We may disclose personal information where reasonably necessary to:

Squarespace and other Website, hosting, analytics and form providers;
email, cloud-storage, document-management and communications providers;
booking, customer-management and marketing platforms;
identity-verification, fraud-prevention and due-diligence providers;
real-estate agents, vendors and property representatives;
solicitors, conveyancers, brokers, inspectors and other advisers involved in a matter;
accountants, insurers, auditors and legal advisers;
government agencies, regulators, law-enforcement bodies and courts;
AUSTRAC where required or authorised; and
another person or organisation with your consent or at your direction.
Service providers may only use personal information for the services they provide, subject to their contractual and legal obligations.
Our current core technology providers include:
Squarespace and its subprocessors, for Website hosting, content delivery, analytics and any Website forms we enable;
Google, for reCAPTCHA and Website-security services where enabled;
Google for email and cloud-storage provider;
Pipedrive CRM for booking or document-management provider
We review our service providers periodically and update this Privacy Policy where material changes affect how personal information is handled.
10. Overseas recipients
Some service providers may process or store personal information outside Australia.
In particular, Squarespace and its subprocessors may process information in the United States and other countries in which they operate. Other cloud, communications, security or technology providers may also process information overseas.
Where the Australian Privacy Principles apply, we take the reasonable steps required by law in connection with overseas disclosures. However, privacy protections in another country may differ from those in Australia.
We will update this Privacy Policy where it becomes practicable to identify additional countries in which personal information is likely to be processed.
11. Security and retention
We take reasonable administrative, technical and physical measures to protect personal information against misuse, interference, loss and unauthorised access, modification or disclosure.
No electronic transmission or storage system is completely secure. You should avoid sending highly sensitive information through an ordinary Website form or unencrypted email unless we have requested it.
We retain personal information only for as long as reasonably necessary for the purposes described in this policy or as required by law, professional obligations, insurance requirements or dispute-resolution needs.
When personal information is no longer required, we take reasonable steps to delete, destroy or permanently de-identify it, subject to lawful recordkeeping requirements.
Where AML/CTF obligations apply, customer due-diligence records are generally retained for seven years after the relevant business relationship ends or an occasional transaction is completed. Other AML/CTF, transaction and regulatory records are retained for the periods required by applicable law.
We seek to avoid retaining unnecessary copies of identity documents where recording the information used to verify identity is sufficient for our legal and operational requirements.
12. Access and correction
You may request access to personal information we hold about you or ask us to correct information that is inaccurate, incomplete, out of date, irrelevant or misleading.
Requests should be sent to nate@roweandco.au and include sufficient information for us to identify you and the relevant records.
We may need to verify your identity before providing access or making a correction. We will respond within a reasonable period.
We may refuse access in circumstances permitted by law. If we refuse a request, we will generally provide written reasons and explain the available complaint options.

Other regulatory or dispute-resolution options may also be available depending on the nature of the complaint.
14. Anonymity and pseudonyms
Where lawful and practicable, you may interact with us anonymously or using a pseudonym.
This may not be practicable when we need to identify you to arrange or provide services, enter into an agreement, verify a review, communicate with another party or comply with legal and regulatory obligations.
15. Children
The Website is not directed specifically at children.
People under 18 should not submit bookings, reviews or community content without the involvement of a parent or guardian.
If we become aware that we have collected a child’s personal information inappropriately, we will take reasonable steps to delete or otherwise address it.
16. Data breaches
If a data breach occurs, we will investigate and respond in accordance with applicable law.
Where the Notifiable Data Breaches scheme applies and a breach is likely to result in serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner as required.
17. Changes to this Privacy Policy
We may update this Privacy Policy when our practices, service providers or legal obligations change.
The current version will be published on the Website with its effective date. Material changes will not apply retrospectively where doing so would be unfair or unlawful.

The Website may contain links to websites and services operated by third parties, including social-media platforms, property services and professional advisers. We are not responsible for the privacy practices, security or content of those third parties. We encourage you to review their privacy policies before providing personal information.
